Federal Vaginal Mesh Lawsuits Filed Against Boston Scientific

Nadrich & Cohen LLP reports that Boston Scientific is facing additional lawsuits in federal court filed by women who claim they were injured by the company’s vaginal mesh implants.

Los Angeles, CA, December 30, 2011 - Legal trouble continues to mount for medical device manufacturer Boston Scientific as additional lawsuits are filed in federal court by women who say they suffered serious injury after receiving one of the company’s transvaginal mesh systems.

The latest lawsuits were filed in Massachusetts and Kansas federal courts. Each of the women who filed suit claims they suffered painful and permanent injuries caused by a Boston Scientific mesh product. According to court documents, the lawsuits allege that the company’s vaginal mesh products migrated and attached to surrounding tissues and did not function properly, resulting in severe pain, tissue damage, infection, swelling and other complications.

Vaginal mesh was first introduced in 1996 as a means of treating pelvic organ prolapse (POP), a condition that can cause stress urinary incontinence in certain women. The mesh is intended to support and reinforce the pelvic floor muscles and prevent the internal organs from bulging outward.

Since 2008, the U.S. Food and Drug Administration has received nearly 3,000 complaints from women who claim they were adversely affected by a mesh implant. In July 2011, the FDA issued an updated safety communication regarding these devices, advising patients and physicians of the potential for serious side effects. The FDA claims it is conducting an ongoing safety review of the devices but to date, there are no plans for a full-scale recall.

In addition to the lawsuits filed against Boston Scientific, hundreds of claims have also been filed against the Johnson & Johnson Company and C.R. Bard. Johnson & Johnson is facing approximately 600 lawsuits involving its Ethicon Gynecare system while Bard is being sued over complications stemming from its Avaulta mesh devices. The first bellweather trials in the Ethicon Gynecare litigation are scheduled to begin in a New Jersey court in November 2012.
