Wright Conserve Hip Implant Lawsuit Plaintiff Seeks Consolidation of Cases

Los Angeles, CA, December 22, 2011 – One of the plaintiffs who filed a personal injury lawsuit against Wright Medical Technologies Inc. over a faulty hip implant is asking a federal judge to consolidate the cases for pretrial proceedings. If the U.S. Panel on Multidistrict Litigation grants the motion, the cases will be heading to trial in the Northern or Southern District Court of Georgia.

Plaintiff Danny James claims that consolidating the cases will help to streamline the trial process and reduce costs for all parties involved. James, along with a number of other plaintiffs, filed suit after sustaining injuries caused by the Wright Conserve hip replacement system. The plaintiffs say the hip implants, which use a metal-on-metal structure, have caused serious pain, tissue damage and in some cases, metallosis caused by the metal components rubbing together. All of the litigants involved are seeking an unspecified amount of damages for their pain and suffering, medical bills and lost wages.

The lawsuits filed against Wright Medical Technologies mirror those filed against Johnson & Johnson’s DePuy Orthopedics. In 2010, the FDA ordered a recall of DePuy’s ASR and Pinnacle hip replacement systems. Since the recall was issued, hundreds of plaintiffs have filed suit alleging serious injury caused by these defective devices. Claims have also been filed against Zimmer and Biomet, alleging injuries caused by defective hip replacement systems.

The U.S. Senate recently proposed a new piece of legislation which would allow for increased safety monitoring of hip implants and other medical devices. If passed, the bill would grant the FDA administrative power to require hip implant manufacturers to conduct ongoing safety reviews of their products after they hit the market.

It remains unclear whether the plaintiff’s motion for consolidation will be granted in the Wright Conserve cases. With new lawsuits being filed every day, consolidation may make sense it the total number of cases becomes unmanageable.
