Sitting While Black? Crowds protest arrest of 2 Black men sitting in Starbucks

Racism prevails once again in Fresno, as D.A. Lisa Smittcamp sends a message that “Blacks” need to shut-up, and (metaphorically) get to the back of the bus.

Barely months after Lisa Smittcamp’s politically motivated case against California Assemblyman Dr. Joaquin Arambula, D.A. Smittcamp is launching another politically motivated case; this time to send a message to the large black population in Fresno: “Sit down; shut up; and you have no rights here!”

Indeed, case M19925289 People vs. Glass, the “Sitting While Black” case, evidences that a Black person will be vigorously charged with crimes, for engaging in the same behavior White people engage in everyday ... or for even simply opening their mouth to speak. Whereas Starbucks’ C.E.O. gave a tearful apology and closed down all Starbucks, for a day of racial sensitivity training; D.A. Lisa Smittcamp has taken a much different approach, trumping up additional charges in the “Sitting While Black” case, which stems from a prior racist court incident (see: https://www.prlog.org/12779871-attorney-cheryl-bigot-browns-facing-disbarment-after-state-bar-asked-to-investigate-false-arrest.html .)

Earlier this week, D.A. Smittcamp filed additional charges against Dr. Glass from Beverly Hills California, (who is a black female;) now alleging that Dr. Glass resisted, obstructed, and delayed a peace officer in conducting his duties in violation of P.C. 148(a)(1); in addition to obstructing or intimidating a public agency in violation of P.C. 602.1(b). However, the sheriff’s report of case # 19-0009166 is directly quoted as stating: “I guided the woman to turn around using her right arm and placed her in restraints. The woman did not resist and no force was used (pg 2, para 3).” Rather than reporting the facts of criminal activity, the sheriff’s report reads more like a “dear diary” entry, by a whining deputy “sobbing” about his personal feelings of inadequacy; and his racist feelings of perceived intimidation by the mere presence of a black person; and his displeasure of being filmed in public. Retired judge Chris Molino commented, “Case law has made the precedent irrefutably clear: filming law enforcement in public, is not a crime. The fact a D.A. would sign-off on this, might be found to be a violation of legal ethics, and could lead to disbarment under Rule 3.8, California Rules of Professional Conduct.”

Indeed, legal ethics may be the least of the problems with the “Sitting While Black” case, as now evidence has surfaced showing further racism and unfairness in the handling of the criminal proceedings, after a racist note was left in the case file by Commisioner Gary Green, resorting to racist name-calling, and referring to Brazilian-Black Dr. Glass as, “a hothead who didn’t want to stip to a Commissioner.” (See court audio recordings Courtroom 13 on 11/21/19 at 12:06 P.M..) History has documented, those of Latin descent are often racially attacked and called names like “hot-head” or “spicy Latino;” even when simply asking a question in a quiet voice.

Commissioner Green’s racist notes are belied by audio recordings, which evidence Dr. Glass being polite and courteous while asserting her rights, even saying thank you; while Commissioner Green bullied her into signing a stipulation under duress ... after-the-fact, and after Dr. Glass was already walking out of the door. “I did not know he was a commissioner, and not a judge. I was tricked and shocked, when I was accosted with this new information, while I had one foot out of the exit door,” stated Dr. Glass. Indeed, court records and witnesses confirm, Dr. Glass “literally” had one foot outside the exit door, before being bullied into signing the stipulation under duress, and even stating on the record, “I’ll sign it under duress.” (See court audio recordings Courtroom 97A on 10/15/19 3:18 to 3:23 P.M..)

“Clearly, D.A. Smittcamp wants to send a message to Black People in Fresno that: they are not free to speak, and they do not have the same rights as Whites,” said a private investigator employed by the A.C.L.U..

“It is shameful that rather than fighting to eradicated crime, in one of the most crime-ridden counties in California, D.A. Lisa Smittcamp is focusing resources on ‘another’ politically motivated case, this time a case to marginalize and silence Blacks,” commented human rights attorney Michael Hale, of the Legal Institute of Human Rights.
