China Publishes Arrangements of Conformity Assessment System for China RoHS 2

The Chinese Authorities have published their implementation arrangements for the conformity assessment system relating to China RoHS 2.

Published jointly by China’s State Administration for Market Regulation (SAMR) and the Ministry of Industry and Information Technology (MIIT), "The Implementation Arrangements for the Conformity Assessment System for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products" describes two routes for conformity assessment.

These are:
• “Voluntary Certification for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Product” (Voluntary Certification)
• “Declaration of Conformity for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products” (Self-Declaration)

Voluntary Certification requires product assessment by Certification Bodies (CBs) in accordance with relevant standards and technical rules on the restriction of hazardous substances. Businesses can then choose the appropriate certification mode for the product, according to “Voluntary Certification Implementation Rules for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products”. Certificates will be issued if the enterprise passes an evaluation of the sample testing and factory inspection, with results being uploaded to the public service platform by the CB within 5 working days of the certificates issuance.

Self-Declaration involves the product providers – producer or authorized representative – independently adopting appropriate methods to complete the evaluation and submit the relevant information to prove product conformity with the relevant standards and technical rules on the restriction of hazardous substances. They must submit all related information to the public service platform in accordance with the “Supplier Declaration of Conformity Rules for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products” within 30 days of a product being placed on the market.

According to the implementation arrangements and “Administrative Measures on Green Product Labeling”, companies following the Voluntary Certification route must use a different label to those using the Self-Declaration route. See the original SafeGuard to see the labels.

Stakeholders should be aware, all products listed in “The Standard Achieving Management Catalog (First Batch)” manufactured and imported after November 1, 2019 must comply with these arrangements.

The implementation of RoHS 2 is supervised and managed through all levels of market regulators and administrative department of MIIT, with SAMR and MIIT both investigating and dealing with reports of violations.
