Franklin Round Table Updates Criminal Defense Lawyers on Immigration Law

Dawn Garcia, a Franklin, Tenn., lawyer practicing immigration law, updated a group of local criminal defense attorneys on the consequences of representing non-citizens in light of the recent United States Supreme Court ruling in Padilla v. Kentucky.

The seminar, presented by the Franklin Round Table, provided Continuing Legal Education credit for criminal defense attorneys.

“Since the Padilla ruling, criminal defense attorneys are required to advise non-citizen clients that they can face immigration consequences, including deportation, because of a criminal conviction,” said attorney Venus Niner, founder of the Franklin Round Table. “Lawyers who fail to adequately advise their clients could face allegations of ineffective assistance of counsel.”

Garcia reviewed the consequences of various types of convictions, and strategies to minimize the consequences to the defendant. Niner focused on strategies to keep criminal defense attorneys in compliance of Padilla and avoid facing allegations of ineffective assistance of counsel. That includes informing clients that if they are not citizens of the United States, any conviction potentially could have serious immigration consequences and that they should consult an immigration specialist if they want advice on that subject.
