Sayles Werbner Announces Lawsuit in Colorado Bus Crash

FORT WORTH, Texas – The Dallas trial law firm Sayles Werbner is announcing a lawsuit filed on Feb. 22 against Fort Worth-based Gotta Go Express Trailways Inc. on behalf of nine church members who were injured following a Colorado bus crash in December 2010.

Noted trial lawyer Mark Werbner, co-founder of Sayles Werbner, filed the lawsuit in Tarrant County’s 236th District Court on behalf of Patricia Davidson and her two minor children; Kenneth and Patricia Marko and their two children; and Aaron and Amy Logan. The case is Patricia Davidson, et al. v. Gotta Go Express Trailways Inc., et al., No. 236-251135-11.

Werbner is widely recognized for his work in bus crash cases and other high-profile courtroom trials. In 2004, he represented the family of a 15-year-old boy who suffered brain damage following a bus crash in Terrell, Texas. Jurors returned with a $71 million verdict for 17 victims, including a $36 million award for Werbner’s client.

The nine plaintiffs injured in the Colorado crash were among more than 45 passengers en route to a ski trip coordinated by the Trinity United Methodist Church in Denton, Texas. The group was traveling on Highway 114 outside Gunnison, Colo., on the night of Dec. 18, 2010, when bus driver Fred Kornegay lost control of the vehicle before it overturned. More than 35 passengers were transported to local hospitals with various injuries.

“Our clients would never have been injured if this company and its driver had used good judgment and followed the law,” says Werbner.

Witnesses told police that Kornegay was operating the bus at excessive speeds prior to the crash, including passing as many as three vehicles at a time on a two-lane road despite dangerous icy conditions and decreased visibility due to snow and darkness. In investigation reports, witnesses said the driver attempted to negotiate a turn while driving too fast. Kornegay, who also is named as a defendant, was cited by police for careless driving as a result of the crash.
