Ukraine Amends Annexes 3 and 4 of its RoHS-like Regulations

Ukraine has amended Annexes 3 and 4 of their Technical Regulations relating to the restriction of hazardous substances (RoHS) in electrical and electronic equipment (EEE).

The amendments relate to the application scope and expiry dates of the corresponding ‘exemption’ lists. These include:

• In the column "Field and term of application" in Annex 3:
o Item 1(a) after the words and numbers "from July 1, 2018" to be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o Item 1(b) after the words and numbers "from January 1, 2018" to be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o Item 1(c) and 1 (d) to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o Item 1(e) after words and numbers "From January 1, 2018" to be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o Item 1(f) to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o In item 1(g), the words "January 1, 2018" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption "
o Items 2(a)(1), 2(a)(2), 2(a)(3), 2(a)(4), 2(a)(5), 2(b)(3) 2(b)(4), 3(a), 3(b), 3(c), 4(a), 4(b)-I, 4(b)-II, 4(b)-III, 4(c)-I, 4 c)-II and 4(c)-III, after the words and numbers "From January 1, 2018", shall be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption "
o Items 4(e), 4(f), 5(b), 6(a), 6(b), 6(c), 7(a), 7(c)-I and 7(c)-II to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o In item 7 (c)-IV, the words and numbers "January 1, 2018" to be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o Items 8(b), 9, 9(b), 13(a), 13(b), 15, 18(b), 21, 24, 29, 32, 34 and 37 to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o In item 39, the words and numbers "January 1, 2018" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
o In position 41, the numbers and the words "January 1, 2019" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
• In the column "Field and term of application" of items 37 and 41 in Annex 4, the words and numbers "January 1, 2019" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

The Cabinet of Ministers of Ukraine approved the changes, in Decree No. 383, on May 16, 2018. They are now responsible for setting the new expiry dates for many of the amended exemptions. Until the new expiry dates are set, manufacturers and importers are advised to follow the current exemptions.
