Brazil Begins Checks on Lead in Paints and Other Surface Coating Materials

On March 21, 2018, Brazil issued Decree Number 9.315 of March 20, 2018, directing the National Institute of Metrology, Quality and Technology (Inmetro) to carry out market surveillance and other enforcement provisions relating to Law Number 11.762/2008.

Law Number 11.762/2008 restricts the amount of lead that can be in paints and similar surface coating materials in buildings used by children, for children’s use and school uses, to no more than 0.06% (600 mg/kg). The law also covers varnishes and similar materials.

The new decree requires Inmetro to collect information and carry out inspections on products to check for compliance with the law. Under the terms of the law, domestic manufacturers and importers are obliged to inform the general public if a product is found to be in violation of the lead requirements. They must also remove the items from sale and/or destroy all non-compliant products.

Decree Number 9.315 became effective on March 21, 2018, the same day as it was published in the Official Journal of Brazil (Diário Oficial da União, DOU).

Stakeholders should be aware Law Number 11.762/2008 does have several exemptions relating to the use of paints, varnishes and similar surface coating materials for the following applications:
• Agricultural and industrial equipment
• Industrial, agricultural and commercial metal structures
• Anticorrosive treatments
• Traffic and safety signs
• Motor vehicles, airplanes, boats and trains
• Graphic design drawings
• Household appliances and metal furniture

The law also exempts inks and similar materials for artistic and graphic design applications.
