13.06.2007 - Andijan, Uzbekistan - On June 12 the consideration of the application of appeal on the case of Gulbakhor Turaeva took place in the city of Andijan. She has been charged on several articles of the Criminal Code of the Republic of Uzbekistan, in particular, the encroachment on the constitutional order of the country, producing or dissemination of materials, which contain the threat to public security and social order, establishment of, leadership and participation in the religious, extremist, separatist, or other banned organizations.

She had been sentenced for six years in prison.

The court proceeding, which took place at the Andijan Regional Criminal Court, has prompted a live interest among the public of the city, journalists, and the representatives of a diplomatic corps accredited in Uzbekistan.

Gulbakhor Turaeva is an educated doctor has been quick to join the world of the so-called human rights protection following the tragic events in Andijan in May 2005. She had not once spoken in the foreign mass media with a severe criticism of the acts by the Uzbek authorities during the assaults of terrorists. However, the accused did go far beyond just criticizing.

In January this year Gulbakhor Turaeva has been detained at the Uzbek-Kyrgyz border, when the authorities had discovered with her a package of the literature banned in Uzbekistan, which had called for an armed struggle against the constitutional order. On the outcomes of the investigation, the sham human rights activist has been sentenced by court to six years in prison.

During the court hearing the accused has once again fully admitted her guilt and said that she had committed a big mistake. “I have been tempted with the money offered to me. I thought that this way I could maintain the well being of my family. But in reality it has turned out to be a direct path to the prison. I have violated the law. I sincerely repent of my deeds and I ask the court for mercy. I have got four minor children and an 83 year-old father, who needs a constant care...

During the investigation I have experienced no pressuring on the part of the law enforcement bodies. Entire process has passed in line with law. One thing that I have chosen the defense lawyer myself whom I had constantly conversed with proves that the law had been fully observed. If to confess – I am glad that I have been stopped on time. Otherwise, I might have committed yet much more serious acts,” – she said.

In her address Gulbakhor Turaeva has also mentioned about the deeds of some the so-called journalists and human rights activists: “I am availing myself of this opportunity to make an official statement about that such people as Galima Bukharbaeva, the German journalist Marcus Bensman, Nigora Khidoyatova, and others by way of lies and deception are attempting whatever it takes to smear the name of Uzbekistan, pose it in the negative light, and make in this the dirty money. In particular, Nigora Khidoyatova by way of lies, deception, and promises to pay me a big amount of money had made me to enunciate the story, which had alleged about that I had personally seen the 500 killed persons during the Andijan events. After all, she had not even paid me. I would want to caution those, who are in the contact with such people that their dealings with them shall bring no good. These are the immoral people, who for the sake of a cheap sensation are ready to commit any dirt”.

Considering that Gulbakhor Turaeva has admitted her guilt and confessed about what she did, her family status, and being guided by the principles of humanism and justice, the court decided to change the sentencing – the six years in prison have been changed to a suspended penalty with a three-year probation term. She has been released in the hall of the court.

The same day the Andijan Regional Criminal Court considered the application of appeal on the case of Gulbakhor Turaeva on the charges of a slander. The sentencing on this case was announced on May 7, 2007. In line with sentencing Gulbakhor Turaeva was convicted of slander against the teachers of the School No.50 of the city of Andijan and had been sentenced to pay fines worth 60 minimal wages (648,000 Uzbek soums). On the outcomes of hearing, the court ordered Gulbakhor Turaeva to pay the mentioned sum of fines.

The defense lawyer of Gulbakhor Turaeva, the director of a private law firm “Najot” (‘Salvation’) Abdukakhkhor Usmanov, is also satisfied with the court decision. “Oh, yes,” he said, “we were not okay with the first decision. This time, I believe, everything is in order. My client has committed a crime, which deserved punishment. But the court had manifested humanism and considered all circumstances of the case. Gulbakhor has sincerely repented, she opened up her eyes, and she wants to return to a normal life, to her family, to her children. She wants to work and make good to her country. I hope that this lesson will do a good to her”.

Gulbakhor Turaeva herself also did not conceal her feelings: “I thank the court for its mercy, for the humaneness and respect shown to me, to my family and my children. Now I am going to devote my life to upbringing my children. I will surely seek an employment and it will surely be with the state. I miss my children and my family very much. I promise that I will never infringe the law. Thank you all”.

In conclusion, it should be noted that Gulbakhor Turaeva is not the first woman towards whom the Uzbek authorities have manifested humanism and mercy. Recently Umida Niyazova has been convicted for the same crime and then released after she had repented.
