New Jersey DWI Lawyer Rachel Kugel Highlights Ignition

Newark, NJ - New Jersey DWI lawyer Rachel Kugel of The Kugel Law Firm (https://thekugellawfirm.com/will-you-have-to-install-an-ignition-interlock-device-if-you-are-convicted-of-a-new-jersey-dwi/) is outlining key ignition interlock device requirements now affecting motorists convicted of alcohol-related offenses under New Jersey's modern DWI framework. Building on the statutory changes that took effect in December 2019 and the voluntary ignition interlock credit system effective February 19, 2024, Kugel is providing guidance designed to help drivers understand eligibility, timelines, and compliance obligations associated with ignition interlock use.

Under the current regime, a New Jersey DWI lawyer notes that ignition interlock devices are central to sentencing outcomes even for first convictions. For a first offense with a blood alcohol concentration between 0.10 and 0.15, courts may require installation for a period commonly ranging from seven to twelve months. For BAC levels of 0.15 or higher, an initial license revocation of approximately four to six months can be followed by an additional nine to fifteen months of interlock usage once privileges are restored. For BAC readings between 0.08 and 0.09, license restoration can occur once an interlock is installed, with a minimum period of approximately ninety days thereafter. These timelines focus on roadway safety while allowing limited mobility for work and essential needs when compliant with court directives.

The 2024 voluntary credit program offers an additional pathway. According to a New Jersey DWI lawyer, drivers charged with alcohol-related DWI offenses may opt to install an ignition interlock before adjudication and receive credit toward future suspension or mandatory interlock periods. First-time offenders may receive day-for-day credit for early installation. For a second or subsequent offense, credited time generally accrues at one day for every two days of pre-conviction installation. The credit program applies only to alcohol-related DWI matters and not to drug-related DUI charges, reflecting a policy emphasis on prevention, accountability, and measurable reductions in impaired driving.

Compliance remains critical. Failure to install a court-ordered device can trigger an additional one-year license suspension under New Jersey's DWI statute. Tampering with, bypassing, or assisting another person in avoiding an interlock requirement may lead to fines and criminal exposure under N.J.S.A. 39:4-50.19. Devices also require rolling retests while the vehicle is in operation. Missed or failed retests can result in temporary lockouts. The required maintenance period does not shrink because of installation delays; the clock generally starts once the device is installed and remains in service for the full mandated duration. In each scenario, a New Jersey DWI lawyer can provide case-specific direction on meeting obligations and documenting compliance.

Several defenses may be available when alleged interlock violations arise. These can include improper installation, device malfunction, due process or notice defects, procedural errors, and documented medical or product-related interference that may cause false positives. Evaluating records, calibration logs, and vendor communications can be decisive. The Kugel Law Firm evaluates these issues, challenges unsupported allegations, and seeks outcomes that minimize long-term collateral consequences.
