Muslim Mortician Faces Legal Action for Wrongful Refusal to Prepare Body of Deceased Homosexual Man in Violation of Texas Occupations Code

In a troubling incident that has raised significant concerns about discrimination and professional ethics, a Muslim mortician in Texas has been accused of unlawfully refusing to prepare the body of a deceased Muslim man, prompting legal action from the family. The mortician claims the man's sexual orientation prevents him from receiving a Muslim burial. The refusal not only raises ethical questions but also appears to violate the Texas Occupations Code regarding Crematory Services, Funeral Directing, and Embalming, which mandates that morticians provide services without discrimination based on sexual orientation.

The incident took place when the family of the deceased, who had passed away due to natural causes, sought the services of the mortuary owned by the accused. The mortician agreed to prepare the body and took payment from the family to do so. Later, the family was met with a shocking declaration from the mortician, who cited his religious beliefs as a reason for his refusal to handle the body of the deceased, instead dumping the body in the parking lot. This denial of service not only caused emotional distress to the grieving family but also sparked outrage among LGBTQ+ advocacy groups and legal experts.

The Texas Mortuary Science Practitioners Act explicitly prohibits discrimination against individuals based on various protected classes, including sexual orientation. The Act states that all licensed morticians must ensure that their services are accessible to all individuals, regardless of personal beliefs. The refusal by the mortician not only violates this code but also contradicts the fundamental principles of dignity and respect that should accompany the handling of the deceased.

In response to this incident, Universal Law Group, a law firm representing the family, has filed suit in Harris County and intends to file a formal complaint against the mortician with the Texas Funeral Service Commission. The family of the deceased has expressed their profound disappointment and anger over the mortician's refusal.
