Listen to the interview on the Business Innovators Radio Network: https://businessinnovatorsradio.com/interview-with-jennifer-surmacz-founder-of-posterity-legal-discussing-the-horrors-of-probate/
One of the key takeaways from Jennifer Surmacz is the discussion on how probate can be a lengthy and costly process. Jennifer highlighted that probate cases can often drag on for years, especially when complexities or disputes are involved. She provided examples of cases, such as Martin Luther King's probate estate, which remains open after 40+ years due to ongoing disputes over various issues.
Moreover, Jennifer emphasized that the costs associated with probate can accumulate significantly over time. She mentioned that court costs, attorney's fees, and other expenses can add up, leading to what she described as "death by a thousand paper cuts." These costs include fees for court processing, publishing notices in newspapers, and other administrative expenses necessary to settle the deceased person's estate through probate.
Additionally, Jennifer pointed out that attorney's fees are a significant component of probate costs. Attorneys handling probate cases often bill by the hour, which can incentivize prolonging the process to increase their earnings. This financial incentive for attorneys can contribute to the overall cost of probate for the estate and the beneficiaries involved.
Overall, Jennifer highlighted the importance of understanding the potential length and costs associated with probate. By showcasing real-life examples, and discussing the various expenses involved in the probate process, she underscored the need for individuals to consider alternatives, such as setting up a trust, to avoid the complexities and financial burdens of probate court.
Therefore, Jennifer Surmacz underscores the importance of understanding that a will alone may not be sufficient to avoid probate. To truly bypass the probate process and its associated costs and delays, individuals should consider setting up a comprehensive estate plan that includes a trust. By establishing a trust and properly funding it with assets, individuals can ensure that their estate can be transferred to beneficiaries without the need for court supervision, ultimately avoiding the probate process altogether.

Image: https://www.globalnewslines.com/uploads/2025/12/1766183100.jpg
For many people, a U.S. visa is only the beginning. What they truly want is certainty - the ability to live, work, and plan their future in the United States without expiry dates, renewals, or ongoing fear that a single decision could unravel years of effort.
That certainty is called a Green Card.
Yet despite its importance, the Green Card [https://larhdellaw.com/] process is often misunderstood. Some believe it is only for…

For international companies with ambitions to enter the United States, few visa options are as powerful - or as misunderstood - as the L-1 Intracompany Transfer Visa.
When used correctly, the L-1 visa allows established businesses to expand into the U.S. market, transfer trusted senior staff, and build a long-term American presence without relying on lotteries, third-party sponsors, or speculative investment routes. When used incorrectly, it becomes one of the…

The B-1/B-2 visitor visa [https://larhdellaw.com/]is often described as the most common U.S. visa. That description, while true, can be misleading. Its familiarity causes many applicants to underestimate how closely these visas are scrutinised - and how easily an application can be refused.
In today's immigration environment, visitor visas are assessed with a level of caution that surprises even experienced international travellers. The rules themselves have not dramatically changed, but how…
