Spencer Law Wins Take-Nothing Verdict in $500,000 Dallas Estate Dispute

DALLAS – Dallas-based Spencer Law, P.C., has won an important verdict for the estate of a deceased man from Garland, Texas, after jurors denied a woman’s assertion that she was the man’s common law wife, effectively rejecting her claim to half of his assets, which were valued at $500,000.

Dallas estate litigation attorney Kevin Spencer, founder of Spencer Law, won the verdict on behalf of the estate of Eddie Paul Baxter after a woman sued the executor of the estate in the probate case with claims that she was due half ownership of Mr. Baxter’s assets based on the purported common law marriage.

Mr. Spencer successfully defended the case, arguing to a Dallas County jury that the evidence clearly showed Mr. Baxter was never married to the plaintiff. In addition to awarding no damages, Judge Brenda Thompson of Dallas County Probate Court No. 1 ordered the woman to pay $25,000 in legal fees to the attorneys representing the executor for Mr. Baxter’s estate. The final judgment was handed down Jan. 15, 2013.
