SGS Brazil Acquires Inmetro Certification Body Accreditation for Toys and Juvenile Products

The Brazilian government has been working intensively to tighten the regulation for consumer products manufactured in or imported into Brazil. All toys placed on the market must be certified by an accredited body recognized by the Brazilian Regulatory Agency Inmetro. Moreover, the regulation requires foreign manufacturers to assign a local representative, who will have not only technical responsibility for the certification process but also legal and criminal responsibility for the products.

In December 2011, Inmetro (http://www.inmetro.gov.br/english/institucional/index.asp) provided SGS Brazil with the accreditation that enables SGS to offer toy certification services granting access to the Brazilian toy market. Acting in conjunction with other certification bodies and laboratories through a series of technical committees, SGS Brazil has worked in partnership with Inmetro to assist in the elaboration of the Compliance Evaluation Requirements.

Some of the recent changes to the Inmetro Compliance Evaluation Requirements for toys manufactured and imported into Brazil are as follows. Although usually using system 5 “QMS Assessment Certification” and 7 “Batch Certification”, novelty for toys is the option for System 4 “Type Tests and Maintenance Tests” – conducted on samples collected in retailers’ and distributors’ plants and warehouses. As consumer products have to comply with the same quality and safety requirements of the national industry, toys must be in compliance with Inmetro Ordinance 321/2009 and Ordinance 369/2007, and the Mercosur Standard NM-300 series (physical & mechanical tests, flammability, toxic elements, experimental sets, chemical toy sets, and electrical toy tests).

Submission of the certification application can be submitted directly to the Brazilian legal entity SGS ICS Certificadora Ltda. For those toy manufacturers and retailers located outside Brazil, certification applications can be made by contacting their nearest SGS office which will forward the application to SGS ICS Certificadora (Certification Body).
