On 12-13 February 2007 FORUM will hold the course "Understanding European and U.S. Patent Litigation" in Heidelberg and on 13-14 June 2007 in Paris.

Patent owners and accused infringers alike must tailor their litigation strategies to the unique laws and procedures of the forum country. This course explores the differences between U.S. and European patent litigation, providing attendees with the tools they need to make important forum-based strategic decisions. From initial considerations such as choosing the forum country with the most favorable infringement laws, to the role of experts, all the way through an analysis of how injunctions and damages differ, this course is designed to help attendees develop forum-based winning strategies.

From the accused infringers perspective, the course will help attendees weigh various defensive options, such as procedures for reconsideration by national patent offices, structuring counterclaims, and pleading affirmative defenses. It will explore the types of evidence required to succeed in each forum, and the best practices for developing that evidence. Taught by a panel of experienced U.S. and European patent litigators and trial attorneys, this course is a must for anyone facing patent infringement litigation in the U.S. or Europe.
