Kubasta Moderates AIPLA Panel Discussion on "Acquired Patents as Litigation Tools"

Dallas, Texas, February 9, 2009 – Kelly Kubasta, partner at Klemchuk Kubasta LLP, moderated a panel discussion at the American Intellectual Property Law Association (AIPLA) Mid-Winter Institute on January 29, 2010. The conference, which was held in La Quinta, California, was focused on identifying opportunities and preserving value in a recovering world economy. In particular, the attorneys in attendance discussed techniques for providing their clients with both effective and efficient legal services.

The panel discussion moderated by Mr. Kubasta was titled "To Buy or Not to Buy: Acquired Patents as Litigation Tools." The various speakers addressed a variety of issues and strategies relating to the identification, acquisition, and use of patents both for offensive and defensive litigation purposes. For instance, two trial lawyers presented opposing viewpoints regarding recommended tactics for representing plaintiffs and defendants in patent infringement lawsuits involving non-practicing entities (sometimes referred to as "patent trolls"). A third speaker discussed procedures for identifying commercially valuable patents and negotiating the acquisition of such patents. The final presenter described the relatively new strategy of defensive patent aggregation, which involves the identification and acquisition of patents deemed likely to be asserted in litigation and the subsequent licensing of such patents to a group of companies likely to be accused of infringement. After the speakers made their presentations, Mr. Kubasta led a question-and-answer session wherein the AIPLA members in attendance engaged in a lively discussion of various topics relating to patent litigation.
