Pozzoli Loses Patent in the Federal German Patent Court

The legal action over the rights of the Belgian-French group of companies BDMO S.A. to market its Double Push Tray internationally without infringing Pozzoli’s European patent EP 0 676 763 – as Pozzoli has claimed – has a long history.
In numerous lawsuits in the courts of the United Kingdom, France and Germany, BDMO has successfully defended its position. In all these suits at law the courts confirmed unanimously that BDMO’s Double Push Tray does not infringe the patent of Pozzoli. Furthermore, following to the action of the BDMO S.A. the said patent of the Pozzoli Spa was revoked in full in all three countries.
Most recently, on February 14th, 2008, the German Federal Patent Court joined with the opinion of the United Kingdom and France and dismissed Pozzoli’s claims that BDMO had infringed their patent EP 0 676 763.
The German ruling is still subject to appeal, as is that in France, however, the decision of the British courts is already legally valid.
The consequence for all BDMO clients, using the Double Push Tray already, is now legally clear and it is that there has never been any legal infringement – contrary to Pozzoli’s claims, and scare tactics, in its communication with market participants. In addition, all those clients still deciding whether to use the Double Push Tray can be certain that BDMO will continue to take all necessary action to defend its position against Pozzoli’s unjustified claims.
BDMO is very satisfied with the results of these numerous lawsuits, as it provides significant evidence for all customers and the international markets that the products of BDMO do not infringe the rights of third parties.
