(openPR) - This week eight clients of the Law Firm of Finebloom & Haenel, a criminal defense firm in Tampa, FL, saw their DUI cases reduced to Reckless Driving, a lesser offense which carries less severe penalties for the defendant . Four of the Tampa DUI charges were reduced for our clients in Hillsborough County. The other four reductions were for our clients in Sarasota and Manatee counties.
Tampa DUI Attorney Stephen Higgins was successful in having a second DUI offense reduced to a charge of Reckless Driving for one of his clients and a DUI with a breath test sample of .141 and .142 reduced to a reckless for another Tampa driver. Higgins and firm founder Darren Finebloom then successfully challenged a client’s suspended license and had her privileges fully reinstated on top of dropping her DUI charge to a Reckless Driving after she was stopped in Hyde Park. Higgins and another of the firm’s lawyers, Ken Poole, had a DUI charge reduced to a Reckless Driving for another one of their clients despite the fact there was a failed field sobriety test and a breath test above the legal limit.
Further South, Darren Finebloom was successfully challenging the breath tests in three separate cases where his clients blew a. 120, a. 128 and .160. All of these blood alcohol readings were well above the legal limit in the state of Florida. Darren was able to get the results of the breath tests excluded when he successfully argued that the breath test machine, the Intoxilyzer 8000, was not properly approved by the State of Florida. Two of the three clients received a withhold of adjudication, which means they can have their records sealed immediately, and all three had their charges dropped down to Reckless Driving.
Firm associate AnneMarie Rizzo also had a DUI charge reduced to a Reckless Driving this week after a triple refusal. Her client refused to take a field sobriety test and was immediately arrested and taken to jail. The client refused to answer any of the officer’s questions or take a breath test while at the jail. Following her investigation, AnneMarie was prepared to take the case to trial before the State reduced the charges to Reckless Driving and he also received withhold of adjudication (no conviction) meaning the charge is eligible to be expunged.
