EU Adds Twelve SVHCs to Authorization List Under REACH

The European Union (EU) has added twelve substances of very high concern (SVHC) to the Authorization List in Annex XIV of REACH, creating entries 32 to 43. The twelve substances are:

32. 1-Bromopropane (n-propyl bromide)
33. Diisopentylphthalate
34. 1,2-Benzenedicarboxylic acid, di-C6-8-branched alkyl esters, C7-rich
35. 1,2-Benzenedicarboxylic acid, di-C7-11-branched and linear alkyl esters
36. 1,2-Benzenedicarboxylic acid, dipentylester, branched and linear
37. Bis(2-methoxyethyl) phthalate
38. Dipentylphthalate
39. N-Pentyl-isopentylphthalate
40. Anthracene oil
41. Pitch, coal tar, high temp
42. 4-(1,1,3,3-Tetramethylbutyl)phenol, ethoxylated
43. 4-Nonylphenol, branched and linear, ethoxylated

There are no listed exemptions for these twelve new SVHCs.

Stakeholders should be aware that the list contains seven phthalates and that anthracene oil (entry 40) has been classified as persistent, bioaccumulative and toxic (PBT), very persistent and very bioaccumulative (vPvB), and would be classified as carcinogenic category 1B if it contains benzo[a]pyrene in a concentration of equal to or greater than 0.005%.

The last application dates and sunset dates for these twelve SVHCs are:

• Entries 32 to 39:
o Last application: January 4, 2019
o Sunset date: July 4, 2020
• Entries 40 and 41:
o Last application: April 4, 2019
o Sunset date: October 4, 2020
• Entries 42 and 43:
o Last application: July 4, 2019
o Sunset date: January 4, 2021

These twelve SVHCs have been drawn from the Candidate List. To use these substances for a specific use, organizations must obtain authorization from the European Commission (EC).

The EU signaled its intention to expand the Authorization List in October 2016 via a notification circulated by the World Trade Organization (WTO). These twelve substances have been taken from recommendations published by the European Chemicals Agency (ECHA) in February 2015 and July 2015. The final regulation was published, as Regulation (EU) 2017/999, on June 14, 2017.
