Hightower Angelley helps fired salesman win contract dispute

DALLAS – A Dallas County jury awarded a verdict of more than $530,000 in favor of a former salesperson for Dallas-based information technology provider PHNS Inc. after finding that the company improperly withheld thousands of dollars in commissions.

Attorneys Jeff Hightower and Wil Angelley from the Dallas law firm Hightower Angelley LLP represented David Canfield against PHNS, which changed its name to Anthelio Healthcare Solutions Inc. last year. PHNS/Anthelio provides IT services for a variety of companies in the healthcare industry.

PHNS hired Mr. Canfield, 64, after purchasing his company in 2003. Mr. Canfield had worked in the healthcare field for 40 years before PHNS fired him despite his positive performance reviews and an established track record of securing lucrative contracts for the company.

During the trial, jurors heard how Mr. Canfield earned multiple contracts for PHNS that generated millions in revenue. According to courtroom testimony, Mr. Canfield signed a sales representative agreement in 2007 that entitled him to commission payments based on contracts he secured on behalf of PHNS. The lawsuit was filed after PHNS denied the commission payments Mr. Canfield was owed under the contract.

In the verdict issued June 12, 2012, jurors found that PHNS failed to comply with the agreement that would have paid commissions to Mr. Canfield for three different contracts he negotiated for the company.

“Our client demonstrated to the jury that he was doing exemplary work for PHNS before the company decided to fire him without cause and ignore the legal contract it had signed with him,” says Mr. Hightower. “We hope this verdict emphasizes to this company and others that they must honor their contracts with salespeople who work hard to generate revenue.”

The verdict in David P. Canfield v. PHNS Inc., No. 11-01974-C, was issued by a six-person jury in Judge Sally Montgomery’s Dallas County Court-at-Law No. 3.
