The Idea Express Group and Idea Express, Inc (IEG), a national company which prints and distributes numerous products, has proven that it will use all legal means to stop trademark infringement on its brand and domain name. The company has successfully filed a complaint and stopped another company from using the name to market products online.

Last year, when IEG realized that someone had formed a new Nevada LLC using the name Idea Express, and had acquired a domain name using their brand, they immediately contacted Los Angeles trademark law firm The Hecker Law Group, PLC. The firm first sent a cease and desist letter, however, the infringing parties refused to relent. Therefore, IEG was forced to proceed in filing a complaint in court. “We didn’t want to sue them, since it’s expensive and really should be unnecessary,” says David Lee, Operations Manager for the company. “However, they seemed to think we were bluffing and refused to stop, even though they most likely knew they were in the wrong.”

Once the other party was served, they did in fact relent and agree to stop using the name. “Their attorney probably told them they would lose, so why fight it,” adds Lee.

According to attorneys for Idea Express, Inc, their marks were already fully valid and enforceable. However, having actively defended the mark sets a valuable precedent which will make it hard for future infringers to contest, which further increases the company’s goodwill and branding value.

"We are quite satisfied with the outcome in the Idea Express, LLC matter and will continue to be vigilant in protecting our brand and trademarks as the only company that can use the name Idea Express to market online.” says Lee.
