Bayer Agrees to Settlement in 70 Yaz Side Effects Lawsuits

Nadrich & Cohen, LLP reports that Bayer has agreed to settlements with a number of plaintiffs who sued the company over Yaz side effects.

Los Angeles, CA, March 5, 2012 – National law firm Nadrich & Cohen, LLP reports that Bayer Healthcare has agreed to settle approximately 70 lawsuits filed on behalf of women who claim they were seriously injured by Yaz birth control pills. The amount of the settlements has not been disclosed.

Yaz was first approved by the U.S. Food and Drug Administration in 2006. The drug’s primary ingredient, drospirenone, is a synthetic form of progrestin that is only found in newer forms of oral contraceptives. It’s believed that drospirenone may be linked to a number of serious complications that have been reported by Yaz users, including blood clots, deep vein thrombosis, pulmonary embolism and stroke.

Problems with Yaz first came to light after several research studies indicated that women who took the drug had a higher risk of experiencing complications, including stroke and blood clots. In October 2011, the FDA announced that women who used Yaz were up 75% more likely to develop a serious blood clot. An FDA advisory panel convened in December 2011 to discuss the safety of Yaz in light of the research findings. Panel members voted to allow Yaz to remain on the market but recommended stronger warning labels for the drug.

Reportedly, thousands of women have filed Yaz lawsuits in state and federal courts across the country. A number of federal lawsuits have been consolidated into a multidistrict litigation in the U.S. District Court for the Southern District of Illinois. The first federal Yaz lawsuit was scheduled to go to trial in January 2012 but Chief Judge David R. Herndon ordered both parties to mediation instead. Last week, Judge Herndon pushed back the date for the first bellwether trials in the Yaz litigation from April to June.

A number of cases have also been consolidated in a Pennsylvania state court. The judge in those proceedings has followed the lead set by Judge Herndon and has also ordered those cases to mediation. Bayer has said that it will continue to consider settlement offers on a case-by-case basis.
