(openPR) - Matrix Energy Inc. is satisfied with and now vindicated by the decision issued October 31, 2011 by The Honourable Mr. Justice Scott of the Federal Court of Canada concluding that defendant, Matrix Energy Inc, “…did not infringe Conserval Engineering’s Canadian Patent No 1,326,619 patent… by making, designing and selling its own MatrixAir™ system”.

The Hon. Justice Scott ruled that because there is no infringement by Matrix Energy that the infringement action is dismissed with costs against the plaintiff. Similarly, The Hon. Justice Scott further ruled that the Trade-mark infringement and passing-off actions brought forward by Conserval are also both dismissed with costs against the plaintiffs.

In October 2007 Conserval Engineering launched a patent infringement suit against Matrix Energy Inc. Since that time Matrix Energy, has vehemently defended its right to offer an alternative transpired solar air heating product to the market.
