Medical Malpractice Insurance Broker Says New York Malpractice System Progressing

A new program in New York courts geared towards expediting medical malpractice cases is gaining momentum. Nexus Insurance Services, a California-based medical malpractice insurance broker, says that this system is one positive step towards possibly improving medical malpractice cases across the United States.

Currently in New York there are courts that specialize in the thousands of medical malpractice cases that are tried each year. One judge in New York, Bronx Justice Douglas McKeon, has been focusing on malpractice cases for the past 15 years, and has become the example upon which this new program will be based.

The pilot program will be using a $3 million federal grant to train more New York judges on medical cases. In addition, cases will be overseen by one judge instead of several judges, which will make the process of investigating and settling malpractice claims go much quicker. Erie County judges are currently being trained under the program.

“The quicker a malpractice claim is settled, the better for everyone involved,” says Michael Kataf of Nexus Insurance Services. “Medical malpractice cases that are long and drawn out are stressful for medical professionals and affect their work. Malpractice cases are also just as trying for the victims, so providing a fair settlement in a more timely manner will allow them to heal and move on with their lives.”

The length of medical malpractice lawsuit depends on a variety of factors. In all cases across the U.S., the initial process includes discovery and bringing in expert medical witnesses. The majority of lawsuits are settled out of court because neither party usually wants to go through the expensive and lengthy litigation process.

“Hopefully this program in New York will be a success so that court systems in other states will take notice. Although it will not resolve the malpractice system as a whole, it could be one step towards progress in tort reform,” said Kataf.
