Sayles Werbner Wins $63.8 Million Texas Verdict for Commil USA In New Patent Infringement Trial Against Cisco Systems

(openPR) - MARSHALL, Texas - The Dallas law firm of Sayles Werbner is announcing a $63.8 million patent infringement verdict for The Woodlands, Texas-based Commil USA LLC against Cisco Systems Inc. (NASDAQ: CSCO) in a second courtroom trial over wireless network technology. This latest verdict eclipses the original trial award by more than $60 million.
The first jury awarded $3.7 million in favor of Commil last May, but the judge ordered a new trial based on Commil’s arguments that the verdict amount was unfairly influenced by prejudicial comments made by a Cisco defense attorney before the jury.
The new verdict in Commil USA LLC v. Cisco Systems Inc., et al., No. 2:07-cv-341, was issued late Friday, April 8, 2011, in the U.S. District Court for the Eastern District of Texas following a one-week trial.
Commil was represented in both trials by Sayles Werbner co-founders Richard A. "Dick" Sayles and Mark S. Werbner. Both attorneys previously have been recognized as “Trial Lawyer of the Year” by the Texas chapters of the American Board of Trial Advocates. Mr. Sayles earned the honor last year after helping win a record-setting verdict in a separate patent trial.

The Commil technology contained in U.S. Patent No. 6,430,395 (the '395 patent) allows wireless devices to move from point to point on a computer network without signal interruption. Prior to this groundbreaking invention, network users experienced frequent signal disruptions resulting in data losses, dropped calls and other errors. Commil filed the lawsuit after discovering that the company’s patented technology was being used by a Cisco subsidiary to produce its own Wi-Fi product line.
