DALLAS, TX--On August 24, 2010, Zach Mayer and Brian Fisher obtained a defense verdict for a national poultry processor in a lawsuit arising out of an on-the-job injury filed by a former employee. During the federal jury trial in the United States District Court for the Eastern District of Texas in Marshall, the plaintiff sought damages for past and future medical expenses, pain and suffering, and mental anguish for lower back injuries allegedly sustained while operating an allegedly defective pallet jack in the course and scope of his employment. Plaintiff alleged that his former employer was negligent in failing to properly inspect and maintain its pallet jacks and in failing to provide a safe workplace for its employees. In a unanimous verdict, the jury found no negligence on the part of the employer and awarded no damages to the plaintiff.
